1. Acceptance of Terms
By creating an account, accessing, or using Love Notes ("the Service"), you acknowledge that you have
read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to
these Terms, you must immediately cease all use of the Service. Your continued use of the Service
constitutes ongoing acceptance of these Terms and any future modifications.
2. Eligibility
You must be at least 13 years of age to use this Service. By using the Service, you represent and
warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained
parental or guardian consent to use the Service.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all
activities that occur under your account. You agree to immediately notify the developer of any
unauthorized use of your account.
4. User-Generated Content & Responsibility
You are solely and entirely responsible for all content you create, upload, publish, and share through
the Service, including but not limited to: text, images, photographs, messages, love letters, and any
other media. The developer does not review, approve, endorse, or assume any responsibility for
user-generated content. You represent and warrant that you own or have the necessary licenses, rights,
and permissions to use and share all content you submit through the Service.
5. Content Policy & Prohibited Use
You agree NOT to use the Service to:
• Upload, share, or distribute content that is illegal, harmful, threatening, abusive, harassing,
tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable;
• Share sexually explicit content, particularly any content involving minors;
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or
entity;
• Engage in stalking, harassment, bullying, or any form of unwanted contact;
• Use the Service to distribute malware, spam, phishing attempts, or other malicious content;
• Attempt to gain unauthorized access to the Service, other accounts, or any computer systems;
• Use the Service for any commercial purpose without prior written consent;
• Violate any applicable local, national, or international law or regulation.
Violations of this policy may result in immediate account termination without prior notice or refund.
6. Intellectual Property
The Service, including its original code, design, graphics, interface, and branding, is the
intellectual property of Kenji Buena and is protected by applicable copyright and intellectual property
laws. You retain ownership of the content you create, but by using the Service, you grant the developer
a non-exclusive, royalty-free license to host and display your content solely for the purpose of
operating the Service.
7. Privacy & Data Collection
Your data is stored using Google Firebase services. We collect only the information necessary to
operate the Service (email, username, and page content). We do not sell, rent, or share your personal
information with third parties for marketing purposes. However, please be aware that:
• Any content you create and share via a link is accessible to anyone who possesses that link and the
corresponding PIN code;
• You are responsible for the security and distribution of your page links and PIN codes;
• We cannot guarantee the absolute security of data transmitted over the internet;
• Data may be subject to the privacy policies and terms of Google Firebase and other third-party
services used by the platform.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER (KENJI BUENA) AND ANY AFFILIATES,
OFFICERS, AGENTS, OR SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
• Loss of profits, data, use, goodwill, or other intangible losses;
• Emotional distress, mental anguish, or psychological harm;
• Privacy violations resulting from user actions or third-party access;
• Unauthorized content sharing or distribution by users or third parties;
• Any harmful, illegal, or objectionable actions committed by users;
• Damages resulting from unauthorized access to or alteration of your data;
• Service interruptions, downtime, or data loss;
• Any matter beyond the developer's reasonable control.
IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO THE DEVELOPER FOR
USE OF THE SERVICE (WHICH IS ZERO FOR FREE SERVICES).
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER
EXPRESS, IMPLIED, OR STATUTORY. THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT
LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND
NON-INFRINGEMENT. The developer makes no warranty that the Service will meet your requirements, be
available on an uninterrupted, timely, secure, or error-free basis, or that any defects will be
corrected.
10. Indemnification
You agree to defend, indemnify, and hold harmless the developer (Kenji Buena), and any affiliates, from
and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses
(including but not limited to attorney's fees) arising from: (a) your use of and access to the Service;
(b) your violation of any term of these Terms; (c) your violation of any third-party right, including
any copyright, property, or privacy right; (d) any claim that your content caused damage to a third
party; or (e) any harmful or illegal actions you perform using the Service.
11. Account Termination
The developer reserves the right to suspend or terminate your account at any time, for any reason, with
or without notice, including but not limited to violations of these Terms. Upon termination, your right
to use the Service will immediately cease. Any content you have created may be deleted without
obligation to preserve or return it to you.
12. Third-Party Services
The Service relies on third-party services including Google Firebase (hosting and database), YouTube
(embedded music), and Google reCAPTCHA (spam prevention). The developer is not responsible for the
availability, accuracy, or policies of these third-party services. Your use of such services is subject
to their respective terms and privacy policies.
13. Modifications to Terms
The developer reserves the right to modify these Terms at any time. Changes will be effective
immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of
the new Terms. It is your responsibility to review these Terms periodically.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of the
Philippines, without regard to its conflict of law provisions. Any disputes arising out of or related to
these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved,
through the appropriate courts in the Philippines.
